Man Arrested for Smoking Pot on Hwy 1 with Baby

Juan Carlos Aguilera received his second DUI citation on Monday.

A Soledad man was arrested Monday evening after a CHP officer spotted him smoking marijuana while driving on Highway 1.

According to Officer Sarah Jackson, Juan Carlos Aguilera, 22, was pulled over just north of the Soquel Avenue exit after an officer saw him swerving his 2002 Lincoln in its lane.

The officer said Aguilera also appeared to be smoking marijuana, and when he approached the car he could smell burnt pot coming from inside.

A DUI investigation was performed, at which point the officer noticed an 18-month old baby and a 20-year-old woman in the back seat of the Lincoln, Jackson said in a prepared statement. 

"Aguilera had driven with the woman and child from Soledad to purchase marijuana at a Santa Cruz dispensary and was driving to the Boardwalk at the time of the stop," Jackson said.

Prior to being pulled over, Aguilera was already on probation for a previous DUI. On Monday, he was taken to Santa Clara County Jail for yet another DUI as well as child endangerment (a misdemeanor) and smoking in a vehicle with a minor (an infraction).
